Terms of Service

1. Who you are contracting with
Tender is provided and sold by Sabrina Bourgeois, an individual seller (“we”, “our”). By purchasing, accessing, or continuing to use Tender, you agree to these Terms of Service.
2. The product
Tender is a private, browser-based IVF journal. It includes guided stages, reflective prompts, motivational quotes, ultrasound photo sections, and a PDF export feature. Your journal entries and uploaded photos are stored in your browser's local storage on the device you use.
Tender is not medical advice and is not a substitute for professional medical care. Always consult your fertility clinic, OB-GYN, or other qualified care team for medical questions.
3. Payment and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
4. Licence
After purchase, we grant you a limited, non-exclusive, non-transferable personal right to use Tender for your own journaling. You may not resell, redistribute, sublicense, reverse engineer, or circumvent technical access controls for the product.
5. Acceptable use
You agree not to misuse Tender, including by:
- using Tender for unlawful activity, fraud, spam, or abusive conduct;
- infringing intellectual property, privacy, or other rights;
- uploading malware or interfering with the security or operation of the service;
- probing, scraping, scanning, or attempting unauthorised access; or
- reselling, redistributing, or making Tender available as a competing product.
6. Your content
You are responsible for the entries, captions, and photos you add to Tender and for ensuring you have the rights to use them. You retain ownership of your own journal content. Because journal content is stored locally in your browser, you are responsible for exporting or backing it up.
7. Intellectual property
Sabrina Bourgeois retains ownership of Tender and its software, documentation, text, design, branding, and other intellectual property. No rights are granted except the limited licence stated in these terms.
8. Availability and warranties
Tender is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or permanent availability. To the fullest extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.
9. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to Tender is limited to the amount you paid for the product in the 12 months before the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, goodwill, or business opportunity. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud, death, or personal injury caused by negligence.
10. Suspension or termination
We may suspend or terminate access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our acceptable use rules.
11. Changes
We may update these terms from time to time. Continued use of Tender after an update means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the jurisdiction in which Sabrina Bourgeois resides, without regard to conflict of laws principles.
